These Terms of Use (“Terms”) govern your use of the TownsKart mobile application (the “App”) and the website www.townskart.com (collectively referred to as the “Platform”).
Please read these Terms carefully before using the Platform. If you do not agree with these Terms, you must not use the services and are requested to uninstall the App.
By downloading, installing, registering, or using the Platform in any manner, you agree to be bound by these Terms and other TownsKart policies, including but not limited to the Privacy Policy, Refund Policy, and Cancellation Policy, as may be updated from time to time. This agreement becomes effective on the date you first access or use the Platform and creates a legally binding arrangement between you and TownsKart.
The Platform may be used by:
Individuals who are 18 years of age or older, and
Legal entities such as companies, firms, or partnerships.
Where applicable, these Terms may be subject to location-specific provisions.
TownsKart operates as a hyperlocal e-commerce and service facilitation platform that connects customers (“Buyers”) with nearby stores, restaurants, merchants, and service providers (“Merchants”).
All commercial and contractual terms relating to products or services are offered by and agreed solely between Buyers and Merchants. These terms include, without limitation:
Product or service prices
Applicable taxes
Delivery or service charges
Payment methods and terms
Estimated delivery or service timelines
Warranties and after-sales services
TownsKart does not control, determine, advise, or participate in the setting of such terms between Buyers and Merchants.
TownsKart may provide support services to Merchants such as order management, delivery coordination, payment facilitation, and customer support under separate arrangements.
TownsKart shall not be responsible for:
Any non-performance or breach of contract by Merchants
Failure of Merchants to fulfill orders
Product quality, quantity, or suitability
Delays due to stock unavailability, preparation time, or operational constraints
TownsKart acts solely as a facilitator. At no point does TownsKart:
Own products
Take physical possession of goods
Hold any right, title, or interest in products or services listed on the Platform
Accordingly, TownsKart shall not be liable for obligations arising from contracts entered into between Buyers and Merchants.
You agree and acknowledge that TownsKart is not responsible for:
Goods or food quality provided by Merchants
Products or services not meeting personal expectations
Incorrect, missing, or substituted items
Availability or unavailability of menu items or products
All product images, food images, menus, and descriptions displayed on the Platform are representative only and may vary from the actual product delivered.
To use TownsKart services, you must create an account. During registration, you may be required to provide:
Name
Mobile number
Email address
Delivery address
You may also provide additional profile information voluntarily. You are responsible for maintaining the accuracy of your information. Personal data is handled in accordance with the Privacy Policy.
Delivery timelines shown on the Platform are estimated only and may vary due to:
Merchant preparation time
Traffic or weather conditions
High demand or unforeseen circumstances
Orders shall be delivered only to the address provided at the time of placing the order. Any change in delivery location may result in cancellation at TownsKart’s discretion, and no refund shall be applicable.
You must provide accurate directions and authorization to accept delivery. Failure to accept delivery or provide proper instructions may result in the order being deemed delivered, and no refund shall be issued. TownsKart’s responsibility ends upon successful delivery.
Payments may be made using available online or offline payment methods through authorized third-party payment gateways.
You agree to:
Use only payment methods lawfully owned by you
Provide accurate payment information
Ensure sufficient funds are available
TownsKart does not store your card or payment details. All transactions are processed securely by third-party payment service providers. TownsKart disclaims liability for unauthorized use of payment methods.
Refunds, cancellations, and disputes shall be handled as per the applicable policies.
Users shall not engage in activities including but not limited to:
Violating applicable laws or regulations
Posting unlawful, abusive, defamatory, or harmful content
Infringing intellectual property or privacy rights
Impersonating others
Posting spam, malicious links, or unauthorized content
Harassing or threatening any individual
TownsKart reserves the right to investigate violations, remove content, suspend or terminate accounts, and take legal action where necessary.
TownsKart reserves the right to modify these Terms at any time by posting updated versions on the Platform. Continued use after updates constitutes acceptance of the revised Terms.
TownsKart reserves the right to introduce additional payment methods or discontinue existing payment methods at any time at its sole discretion.
If you choose to make payments using an online payment method, such payments shall be processed through authorized third-party payment service provider(s). With your consent, your payment details may be securely stored by such third-party payment service provider(s) for facilitating future transactions.
TownsKart does not store, process, or retain your credit card, debit card, or other payment instrument details. All payment transactions are handled securely by third-party payment gateways in accordance with applicable laws and industry standards.
You agree and acknowledge that:
You shall use only payment methods that are lawfully owned by you
You are responsible for maintaining sufficient balance or credit to complete any transaction
Any failed payment due to insufficient funds or incorrect details shall be your responsibility
To the extent applicable and as permitted by law, TownsKart shall facilitate support for payments made on the Platform, including matters relating to refunds, cancellations, chargebacks, and dispute resolution, provided such requests are reasonable, justifiable, and made in accordance with these Terms and the applicable Refund and Cancellation Policies.
